Right, so as you may know my six is up for sale.
It's just suddenly occurred to me that with no tax or insurance on it, any prospective buyer would surely be breaking the law test driving it.
I've had a quick google search and there seems to be mixed opinions on what is within the boundaries of said law, regarding this situation.
I, obviously, have no problems with the car being test driven, as it drives fine, but what Would be the 'right' thing to do regarding no road tax/insurance. It seems that some people think that if they're insured on another vehicle that this would cover it. I, personally, don't think this is correct.

Most insurance companies state you are insured to drive any vehicle and covers you 3rd party only as long as the other vehicle is insured. As for tax unless its a private road the car shouldnt be driven on a public road. If whoever was driven was to crash or get stopped the blame would come back to you with you being the owner

As above. Untaxed cars can only be driven on the road with trade plates or pre-booked mot. It all comes back to you as the owner if the test driver is pulled. Unless you say they stole it!!

illegal and its as clean cut as that in the eyes of the law. Trade plates will allow it.

I can drive any other car third party but that car still has to be insured, taxed and mot'd and have the owners permission.

Yep, that, clear as day really, unless you tax and insure or they have trade plates its a big no.

Or you have a private test track where the public has no access.

I thought this was the case.
It's going to the garage, for the cam belt/service, on trade plates, so not a problem.

How does this work out of interest? Are the garage picking it up and using the plates or are you a trader?

Curious as might be handy when getting a few bits done to my untaxed Rallye Yes

This has also made me think, if someone bought it, and drove it away with no tax or insurance (if they were that way inclined) with the car signed over to them, presumably it's completely their responsablity and no come back on me.

(This is purely a hypothetical situation, just something that crossed my mind)

When I sold the Pug the other day, I made sure I wrote them up a receipt saying the usual sold-as-seen etc, his details, my details, everything I could think of.

As it happens he did manage to sort insurance (although I never checked), but as far as I'm (and I believe the law) is concerned, once you hand over a receipt it's no longer your car and it's no longer your problem. The V5 only shows the registered "keeper", not the "owner". The latter there's no fixed way of proving, other than a receipt he's signed saying it's his now.

Not your car anymore, not your problem. It'd only be a pain in the arse because any ANPR or Police stuff would come through to you for the first couple of weeks until the V5 was sorted. Happened to my parents a few years ago, they got through a speeding ticket for a car they'd sold, sent them the receipt, got sorted.

No reason not to get tax these days if you're insured though, you're allowed to drive for 14 days without a tax disc as long as you've paid online.

Or, y'know. People don't drive uninsured.

The best thing you can do when selling is to make a note of the current mileage, date and time on the V5C and a receipt and both sign it. Do that regardless of whether they say or show you insurance/tax for the vehicle.

Or just break it to save any hassle.

    I would drive home without MOT & TAX no probs done so many times before, once insurance is in place its go go go.
