Looking for a bit of advice:

Received a letter from my local plod the other day stating that I was to be fined for non display of a tax disc.

Date of supposed infringement: 03/07/2012

My problem is that my car has 12 months tax on from October last year and at no point over the past month have I had to stick it back in my windscreen.

I was displaying the tax disc and have been since I bought it in October last year.

What do you reckon my next step should be - send back the letter stating that I was the driver of the vehicle at that time with a letter attached explaining the situation?

Any advice much appreciated Thumbs up

its not particularly clear, are you saying you were or were not displaying the disc?

not sure mate but I think that's hat you will have to do, one of my little ones swapped mine for one from 06 and I drive about with it for up to 6 months, never noticed until I retaxed it.

As the offence is 'non dispaly of tax disc' you are guilty as you have not displayed your tax disc.

Contact whoever has given you the fine (police or DVLA), expalin the situation and hopefully they'll let you off as you can prove that you have valid tax, it just wasn't displayed.

Sorry as welsh says i have not explained it very clearly.

I was displaying the tax disc and have been since I bought it in October last year.

Do you reckon that they would have photographic evidence of the offense or is it my word against theirs?

So you were displaying your tax disc and you are getting a fine for not displaying your tax disc?

does it tell you where this took place? id send a letter back to them explaining you live for the 306 and that you dont need to display your tax!! i would just explain to them the tax has been displayed since you bought the tax so you have no idea why you have this fine, see what there reply is, an when you get an £80 fine through, id take it to court as if there is no photo evidence its there word against yours so would get squashed i think since you do have tax, no like you never had it!!

I don't know how they would prove it, but if its anything like parking fines these days they would have a picture.

    They should have a picture I'd have thought. Where abouts is your tax disk? Needs to be a places thats easily seen and not covered. I'd contact them and go from there.

    I had this a few years back, the disc had fallen off and I hadn't realised, the offence was upheld as it is illegal to have a tax disc not on display.....even though the car's taxed!

    Yes, it is an offence not to display a valid tax disc...

    It must be placed in the lower left hand corner of the windshield so that a police officer is able to view it whilst standing on the nearside kerb. Wink

    What does the letter say exactly? The police don't prosecute for ved offences, they pass your details onto the dvla who decide to take it further or not...usually not.

    If you are sure it has never fallen off ask for evidence?

    If you found it on the pass floor one day I would guess you will be stuck with the fineThumbs down

    only time you can get away without displaying the disc is for 5 days after buying on-lineYes

    I'm sure you can have it anywhere on your windscreen as long as it can be seen? That or the po po are foooooking lazy! LOL

    i would definately be asking for some evidence.

    if it was a traffic warden then they will have a picture.

    not sure on the position of the tax disc as a customer of mine had a Morgan and its tax disc is in a holder on the front wing just behind the wheel

    I thought that was the craic, well, I realised last night that my tax expired at midnight, so I bought it on-line.

    I'm gonna leave my old one in though, just so it looks genuine from afar :p

    I first read that as I live IN the 306!!

    Tax disc is in the lower left hand corner of the windscreen which as stated is a legal requirement. There are various exemptions for motorbikes, cars with no windscreen etc so maybe the morgan falls under one of these.

    Letter is from Strathclyde police - time of offence taking place - 4.50am right outside my flat - must of been a very bored PC plod!!

    I would scan the letter in but appear to have lost it - arrrrrgh!!!

    Seems a bit archaic that we still need to display a piece of paper in our windscreen when all of the data is held on a database. I dont drive around with my MOT or insurance certificates attached to my windscreen. Angry

    cant remember what side its on tbh, think its the drivers side though.

    what happens in my high street then? its a one way street with parking on both sides. so if i park on the right hand side, the traffic warden aint going to see it clearly from the off side kurb lol

    and on another note it could be someone just being a total c*nt.

    i left my old mondeo in a street opposite my mates house, its gearbox was knackered. it sat there for 8 months.

    On the tuesday i booked it into the garage for thursday and said i would drop it off wednesday after work. went to move it on the wednesday and it had been clamped by the dvla for no tax.

    The stupid bint next to my mate complained about it. even though i told her the week previous it would be moving next week. cost me 240 quid to get it released. Sad
