Just my two pence..A good friend of mine happened to overtake an off duty police officer & two cars on a straight section of B road ( he was a Bmw driver haha Thumbs up ) That copper decided it was dangerous driving & then got in contact with the two other drivers my friend overtook & got written statements to back the coppers story up ending up with my friend loosing his license for 12 months & having to take a retest, The whole thing was in the local newspaper too! Not much happens in Davidstow,Cornwall..

On the other hand if its his word against yours it the Cps would throw it out of a court,My sisters works for the Cps & you'll be surprised at how many serious cases don't secure convictions due to lack of evidence..

Just a slap on the wrist I would of thought pal.

yeah 12 month ban is guaranteed if found guilty, with the possibility of some jail time and bankrupting fines, yay lucky me. i just wish i could remember the overtake, if its going to lose me my license i wish it could be for something amazing, not something i cant remember No

As said, due care and attention is the most you will get.

As far as i can tell you never did it, i would easily remember 3 cars as i never overtake more than 2 cars at a time and i have a bad memory at times.

Unless he had video recording in his car or another witness he has no evidence, just say no comment until they show you evidence.

Admit to nothing and it's for them to prove, If no Video footage etc it could have been anyone, or even a Cloned car, Wink Wink
My best mate had all this after wheeling his bike in Poole past the main Police station and a Police car behind him (Super Big NooCool and the book to be thrown at him, the few weeks past where they need to inform you of this but thankfully nothing came.

well apparently he got my registration, i dont know how as its dark at 5pm and if i really was driving dangerously then he wouldnt of had time to see it. and i think its funny that he could read my reg when driving but when they turned up at my house mistook my parked up meridian for the gti6 LOL

All these stories make me laugh - cops making a nuisance of themselves basically. Dont be a bender and go to the police station, let them come and speak to you if they wanna waste even more of their time and yours. Look in order to prosecute you they need evidence and your entitled to view that evidence to form a defense. As there's blatantly no evidence there is no problem. Been here done it got the t-shirt. Dont waste your money on a solicitor. They will take a few hundred of you 'just to make sure we're prepared when you do get a court summons' yeah what a load of tosh. (not that I got fooled into parting with my hard earned cash) Sit back relax and take a chill pill nothings gonna happen.

There was this one time I was on crack and drunk and drove through a school but called this dodgy lawyer and he got me off the hook. Justice!

I know coppers can be cnuts sometimes, but you only have to watch enough of these Police programmes on telly to see how much people actually get away with; people get into entire chases or drive across parks before legging it and get let off because there's not enough evidence.

If it were me, I'd go to the Police station, be polite, be cooperative, but make it clear you don't remember the incident in detail and won't be admitting to it. There's no way it'd get through in court with zero evidence. I know it's really shitty, I've had similar moments where you do something you know is safe in your car and for your ability and think nothing of it, but realise after that if a copper had been watching you'd be done for. It's a horrible feeling, especially if you know you've done nothing wrong.

I'm sure it'll be fine though, luckily much as people complain this country's legal system is very good, and no evidence usually means no prosecution.

Yeah I regularly watch the police program's and it is surprising how many do get off for what I'd consider a serious offence, and yet genuine good people normally get screwed. I think lack of solid evidence should help me. I've done some stupid things driving, mostly in my old 1.4 but in the gti6 I've tried to stay within the law. A clean driving record should help too I hope.

It certainly will, if you went to court and said look, I genuinely don't know what I'm meant to have done, I don't remember it happening, there's no proof, I've got a full, clean licence you should be fine.

I'm pretty sure the magistrates don't actually know what's on your licence until they issue the points.

I am prepared to take this to court if I have to to prove my innocence, I've looked into solicitors just in case.

Funny you say that, I got let off doing over 110 in a 50 (was at 3am)

I got pulled over, shouted at, told I was going to court to lose my licence, lectured and then let off. I think if I'd have kicked off it may have been taken further but I just took the bollocking and apologised.

No offence but I don't know you from Adam, at 21 you're still a relatively inexperienced driver (statistically) and your perception of what is safe driving might be very different to an advanced driver qualified police officer.

My advice would be to go and listen to what they have to say and then you'll know the whole story. If you get a verbal warning, accept it and move on. If they intend to prosecute and you feel it's unjustified then seek legal advice as much of what has been said in this thread is incorrect.

I agree with your point there, in theory an experienced advanced driver should have a better perception of what is safe but is that enough for his word to be more valid than mine?

we all make mistakes and that is a lesser charge to drink driving ! and my dodgy solicitor is probably the best in the country Wink
